Services Passing a Bicycle Too Closely

Passing a Bicycle Too Closely

About This Charge

Section 148(6.1) of the Highway Traffic Act requires a driver passing a bicycle travelling in the same direction to leave a minimum distance of one metre where practicable. A conviction brings a fine of $60 to $1,000 and two demerit points. The one-metre threshold is precise, but proving a driver actually crossed it — as opposed to appearing close — is not always straightforward, and the Crown has to establish that beyond a reasonable doubt. R.S. Walia examines what the evidence can actually support on distance and positioning before a client accepts the ticket as written.

Potential Consequences

  • Fine of $60 to $1,000
  • 2 demerit points on conviction
  • Crown must prove the one-metre distance was not maintained

Why Representation Matters

A traffic charge is not proven simply because it was laid. The prosecution has to satisfy a number of technical requirements — accurate officer notes, properly calibrated equipment, a stop conducted the way the law requires. Where one of those is missing or flawed, a charge can be reduced or dropped. Mr. Walia goes through the disclosure on every file precisely to find that ground before the case is ever called.

Licensed paralegals are fully entitled to act for drivers in Provincial Offences Act matters. It means you can have an experienced advocate in your corner without paying what a lawyer would cost.
